That is not correct. They sued the tribe as well as individual tribal members. A copy of the top of the filing is below.

Was Larry Kestner background checked when he ran in 2022
Yes. Like all candidates Larry underwent and passed background checks both in 2022 and 2025. The speculation on Facebook is just that unfounded speculation. The same is true for the allegation of Larry having any type of criminal record. As to the speculation about Larrys diving record, as a retired USPS worker Larry had to meet strict requirements on his driving record.
Did Dave Barnett enroll people into the tribe who were not eligible for enrollment
No. All those enrolled by the tribe must follow enrollment rules laid out in the Cowlitz Tribal Constitution. This includes review by the Enrollment Committee and approval of Tribal Council. There is no truth to this social media rumor.
